� <br />1�'�� <br />`/� <br />7 January 2009 <br />Eugene Schultz <br />President, G&K Properties <br />7195 137t" Street North <br />Hugo, Minnesota 55038 <br />.�. <br />RE: PUD Agreement for Lexington Professional Building, 1940-1944 Lexington Avenue <br />Dear Mr. Schultz, <br />Enclosed with this letter you will find a copy of the existing/previous PUD agreement that is on <br />record at Ramsey County and that shows in red the changes made as a result of the amendment; <br />you may keep this for your records. You will also find enclosed the amended PUD agreement <br />based on the September 24, 2007 City Council approvals; this is the same as the recorded <br />document except for the added "Amended Agreement" paragraph on page 1, a modification to <br />the "Permitted Uses" section on page 5, the elimination of the "Uses - Conditional" section (on <br />page 5 of the original document), and the information on pages 9-10 identifying G&K Properties <br />as the property owner. <br />The City Code requires newly-approved PUD Agreements to be sent to Ramsey County for <br />recording within 60 days of its approval by the City Council; although the Code does not as <br />clearly establish procedures for processing PUD Amendments, it would behoove you to sign and <br />return the amended PUD Agreement as soon as possible to minimize the possibility that its <br />validity can be called into question. <br />At your very earliest opportunity, please review the amended PUD Agreement, sign it in the <br />presence of a Notary Public, and return it to me. If it's convenient for you to sign and return the <br />document in essentially the same motion, several employees here at City Hall are Notaries.
