-• - llraft Planning Commission Minutes Attachment D PLANNING FILE 07-051 Request by Ms. Najmieh Rezakhani for a CONDITIONAL USE PERMIT (CUP) to allow a hair salon home occupation at 425 Wagner Street. Chair Bakeman opened the Public Hearing for Planning File 07-051. Associate Planner Bryan Lloyd reviewed the request of the Ms. Rezakhani, to operate a small hair salon from her home; and reviewed permitted home occupation uses and limitations detailed in Section 1004.01G (Home Occupations) of Roseville City Code. Staff recommended APPROVAL of a CONDITIONAL USE PERMIT (CUP) for Najmieh Rezakhani, 425 Wagner Street, to allow the proposed in-home salon, based on the comments and findings of Sections 5 and 6 of the project report dated September 5, 2007. Discussion included American Disability Act (ADA) requirements for non-commercial property and building permit regulations rather than land use considerations that would address those issues; and home-based business licensing requirements and monitoring. Chair Bakeman requested that staff provide ADA information in the file prior to City Council review and consideration. Applicant, Najmieh Rezakhani Ms. Rezakhani was present, and responded to Commission questions regarding her intent for the business, future employees and/or growth and expansion. Ms. Rezakhani advised that she had no intention of adding additional chairs or employees due to her full-time work; limited space availability (approximately 350 — 400 square feet); and noted she would not be opposed to the Commission prohibiting outside employees or limiting the space for the home-based business. Public Comment Sheila Mahnken, 2599 Lexington, #513 Ms. Mahnken questioned how seeing only fve (5) clients each week would provide adequate income; and expressed her concern that additional clients above the projected number may create parking or traffic issues. Staff reviewed the limitations on hours or operation, parking, and other items addressed by existing City Code and Conditional Use Permits related to home-based businesses. Further discussion included neighborhood impacts and considerations for parking and traffic; and the CUP staying with the property. Commissioners expressed their appreciation to Ms. Rezakhani for her honesty in seeking an application for her home occupation. Chair Bakeman closed the Public Hearing. MOTION Member Boerigter moved, seconded by Member Gasongo to RECOMMEND APPROVAL of a CONDITIONAL USE PERMIT (CUP) for Najmieh Rezakhani, 425 Wagner Street, to allow the proposed in-home salon, based on the comments and findings of Sections 5 and 6 of the project report dated September 5, 2007. Ayes: 7 Nays: 0 Motion carried.
