-• - <br />llraft Planning Commission Minutes Attachment D <br />PLANNING FILE 07-051 <br />Request by Ms. Najmieh Rezakhani for a CONDITIONAL USE PERMIT (CUP) to allow a hair <br />salon home occupation at 425 Wagner Street. <br />Chair Bakeman opened the Public Hearing for Planning File 07-051. <br />Associate Planner Bryan Lloyd reviewed the request of the Ms. Rezakhani, to operate a small <br />hair salon from her home; and reviewed permitted home occupation uses and limitations detailed <br />in Section 1004.01G (Home Occupations) of Roseville City Code. <br />Staff recommended APPROVAL of a CONDITIONAL USE PERMIT (CUP) for Najmieh <br />Rezakhani, 425 Wagner Street, to allow the proposed in-home salon, based on the comments <br />and findings of Sections 5 and 6 of the project report dated September 5, 2007. <br />Discussion included American Disability Act (ADA) requirements for non-commercial property and <br />building permit regulations rather than land use considerations that would address those issues; <br />and home-based business licensing requirements and monitoring. <br />Chair Bakeman requested that staff provide ADA information in the file prior to City Council <br />review and consideration. <br />Applicant, Najmieh Rezakhani <br />Ms. Rezakhani was present, and responded to Commission questions regarding her intent for the <br />business, future employees and/or growth and expansion. Ms. Rezakhani advised that she had <br />no intention of adding additional chairs or employees due to her full-time work; limited space <br />availability (approximately 350 — 400 square feet); and noted she would not be opposed to the <br />Commission prohibiting outside employees or limiting the space for the home-based business. <br />Public Comment <br />Sheila Mahnken, 2599 Lexington, #513 <br />Ms. Mahnken questioned how seeing only fve (5) clients each week would provide adequate <br />income; and expressed her concern that additional clients above the projected number may <br />create parking or traffic issues. <br />Staff reviewed the limitations on hours or operation, parking, and other items addressed by <br />existing City Code and Conditional Use Permits related to home-based businesses. <br />Further discussion included neighborhood impacts and considerations for parking and traffic; and <br />the CUP staying with the property. <br />Commissioners expressed their appreciation to Ms. Rezakhani for her honesty in seeking an <br />application for her home occupation. <br />Chair Bakeman closed the Public Hearing. <br />MOTION <br />Member Boerigter moved, seconded by Member Gasongo to RECOMMEND APPROVAL of <br />a CONDITIONAL USE PERMIT (CUP) for Najmieh Rezakhani, 425 Wagner Street, to allow <br />the proposed in-home salon, based on the comments and findings of Sections 5 and 6 of <br />the project report dated September 5, 2007. <br />Ayes: 7 <br />Nays: 0 <br />Motion carried. <br />
