5.0 STAFF COMMENTS: <br />5.1 Section 1013 of the Roseville City Code allows the City Council to grant CUPs for land <br />uses that are conditionally permitted in a zoning district and to impose any additional <br />conditions deemed necessary to protect the public health, safety, and general welfare. <br />5.2 Section 1004.O1G (Home Occupations) of the City Code permits certain home <br />occupations on single-family residential properties, provided that the use is "secondary <br />and subordinate to the principal residential use of the property"; subsection 2j(3) <br />stipulates that an in-home salon is a conditional use, thus a CUP is required. <br />5.3 Subsection 1004.O1G2a limits the total floor area dedicated to the home occupation to the <br />lesser of the following: <br />a. 30% of the of the floor area of the home; or <br />b. 600 square feet <br />5.4 In addition to any residents of the home, Subsection 1004.01 G2b allows up to 1 full-time, <br />non-resident employee to work at a home-based business. <br />5.5 Subsection 1004.01 G2e allows a maximum of 2 additional vehicles to be parked on or <br />near the property at any one time that are related to the home occupation. <br />5.6 Subsection 1004.O1G2f stipulates that deliveries of products, merchandise and supplies <br />may only be made by single rear-axle straight trucks or other vehicles commonly used for <br />deliveries in residential neighborhoods. <br />5.7 Subsection 1004.01 G2h allows hours of outwardly-visible signs of operation, including <br />deliveries and client arrivals, between 8:00 a.m. and 8:00 p.m. <br />5.8 Planning Division staff believes that the requirements of § 1004.01 G, which regulate <br />home occupations and which have been excerpted above, are sufficient to ensure that the <br />proposed in-home hair salon will operate in a manner that is compatible with the <br />suF-rounding residential uses, pending the following review of CUP-approval criteria. <br />6.0 REVIEW OF CONDITIONAL USE PERMIT CRITERIA <br />6.1 Section 1013.01 (Conditional Use Permits) of the City Code requires the Planning <br />Commission and City Council to consider the following criteria when reviewing a CUP <br />application: <br />a. Impact on traffic; <br />b. Impact on parks, streets, and other public facilities; <br />c. Compatibility of the site plan, internal traffic circulation, landscaping, and <br />structures with contiguous properties; <br />d. Impact of the use on the market value of contiguous properties; <br />e. Impact on the general public health, safety, and welfare; and <br />f.
