4.0 BACKGROUND: <br />4.1 Mr. Heffernan owns the property at 893 County Road C2, which has a Comprehensive <br />Plan designation of Low-Density Residential (LR) and a zoning classification of Single- <br />Family Residence District (R-1). <br />4.2 This Conditional Use Permit request has been prompted by the applicant's desire to <br />construct a 1,008-square-foot detached building. <br />5.0 STAFF COMMENTS: <br />5.1 Section 1004.O1A1 (Number Allowed) of the City Code permits up to 2 accessory <br />buildings on a single-family residential property. <br />5.2 Section 1004.O1A3 (Size Limit) limits the total floor area of accessory structures to the <br />lesser of the following: <br />a. 40% of the required rear yard area (i.e., 1,272 square feet on this property); or <br />b. 864 square feet <br />5.3 Section 1004.O1A4 (Requirements for Increased Size), however, allows up to 1,008 <br />square feet of accessory building floor area with a Conditional Use Permit (CUP). <br />5.4 Section 1004A1A5 (Overall Area) further limits the size of accessory buildings by <br />stating that the combined floor area "of attached garage and detached accessory <br />building(s) shall not exceed the exterior dimensional footprint of the principal structure, <br />excluding any attached garage footprint." The existing attached garage plus the proposed <br />1,008-square-foot accessory building adds up to about 1,465 square feet, whereas the <br />residential footprint of the principal structure (not counting the attached garage) is about <br />1,725 square feet. <br />5.5 The area of the subject property is approximately 35,600 square feet; § 1004.O1A6 <br />(Maximum Total Surface Area) of the City Code permits up to 10,680 square feet of <br />impervious coverage on a lot this size. Existing impervious surfaces cover about 3,340 <br />square feet, and the proposed detached structure would increase the total impervious <br />coverage about 4,350 square feet (12% of the total lot area). <br />5.6 All of the above Code requirements work together to allow the proposed structure, but <br />this one building will utilize the maximum extent of such allowances and preclude the <br />construction of any other accessory buildings on the property. <br />5.7 Section 1004.O1A13 (Driveway Required) requires that any accessory structure large <br />enough to accommodate one ar more vehicle be provided with a paved driveway that has <br />access to a public street; if a detached building is to be used for yard equipment, collector <br />cars, or other seasonally-used vehicles instead of daily-use vehicles, however, no <br />driveway is required. <br />PF07-052 RPCA 090507 <br />^ �—.
