b. The principal structure must remain a minimum of 3 feet from the southern side property line; c. The existing garden shed must be removed from the property prior to the issuance of the Certificate of Occupancy; d. Measures must be taken to provide on-site mitigation of storm water from the marginal impervious surface area. Such mitigation measures may include directing rain gutters toward the interior of the lot, installing and maintaining a "rain garden" filtration basin, or some combination of these or other measures as approved by the City Engineer; and e. The variance shall expire 6 months of the approval date if a building permit is not issued, pursuant to § 1013.03 of the City Code. 7.0 SUGGESTED ACTION 7.1 ADOPT VARIANCE BOARD RESOLUTION 62 APPROVING THE REQUESTED VARIANCES to Section 1004 and Section 1012 of the City Code that would allow the proposed residential addition at 2613 Fry Street, based on the comments and findings of Section 5 and the conditions of Section 6 of the project report dated July 11, 2007. 8.0 NEXT STEPS 8.1 The decision of the Variance Board is �nal unless an appeal is fled. The appeal period remains open for 10 days from the date of the decision, and an appeal may be made either by the applicant or by another Roseville property owner. 8.2 An appeal must be submitted in writing to the City Manager by NOON on July 23rd, 2007 for a hearing before the City Council. 8.3 If no appeal is filed, a building permit may then be issued, and Community Development staff will mail the resolution approving the variance to Ramsey County for recording against the subject property.
