6.0 STAFF RECOMMENDATION <br />6.1 Based on the comments and findings outlined in Section 5 of this report, the Planning <br />Division recommends APPROVAL of Ms. Simonson's request for a 20-foot wetland <br />setback VARIANCE required in § 1016.16A (Setbacks from Water Body) of the City <br />Code, to allow the proposed driveway improvement on property that is currently <br />addressed as 2950 West Owasso Boulevard, with the following conditions. <br />a. The improved driveway must not be less than 10 feet from the wetland boundary <br />as delineated on the survey reviewed as part of this variance application; <br />b. The improved driveway must be sloped to direct rain water runoff to the north, <br />away from the nearest wetland. The pitch of this slope must be approved by the <br />City Engineer prior to the issuance of the permit; <br />c. The applicant must work with staff to determine whether any additional storm <br />water filtration and/or rate control measures must be implemented in order to <br />further minimize the impacts of the improved driveway on the nearby wetland; <br />and <br />d. The variance shall expire 6 months of the approval date if a building permit is not <br />issued, pursuant to § 1013.03 of the City Code. <br />7.0 SUGGESTED ACTION <br />7.1 ADOPT VARIANCE BOARD RESOLUTION 63 APPROVING THE <br />REQUESTED VARIANCE to Section 1016 of the City Code that would allow the <br />proposed driveway improvements, based on the comments and findings of Section 5 and <br />the conditions of Section 6 of the project report dated July 11, 2007. <br />8.0 NEXT STEPS <br />8.1 The decision of the Variance Board is final unless an appeal is filed.
