WHEREAS, Section 1012.01 B(Supplemental Lot Requirennents) requires a <br />minimum side yard setbac:k of 5 feet for principal structures; and <br />WHEREAS, the Dubbledees seek to encroach up to 2 feet into the side yard <br />setback; and <br />WHEREAS, the Pl.anning Division has concluded that "hardships" �are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFOF:E BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 2-foot VARI:ANCE to Section 1012.O1B, and a 600-square-foot <br />VARIANCE to Section 1()04.01 A(6) of the City code, subject to the following <br />conditions: <br />1. The size and e;ctent of the proposed addition and the resulting impervious <br />surface area must not exceed that which is illustrated in the plans reviewed <br />with this applic;ation; <br />2. Measures mus1: be taken to provide on-site mitigation of storm water from the <br />marginal impexvious surface area. Depending on the characteristics of the soils <br />and slopes on t:he property, such mitigation measures may include directing <br />rain gutters to�vard the interior of the lot, installing and maintaining a"rain <br />garden" filtration basin, or some combination of these or other measures as <br />approved by the City Engineer. Building permits will not be issued until the <br />City Engineer has approved the plans for the on-site mitigation of the storm <br />water runoff from the marginal impervious coverage; and <br />3. The existing garden shed must be removed from the property within 6 months <br />of the issuance: of the Certificate of Occupancy; <br />4. Pursuant to § 1013.03 of the City Code, the VARIANCE shall expire 6 months <br />after the approval date if a building permit is not issued. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Member Martinson and upon vote being taken thereon, the following voted in favor: <br />Members Boerigter, Dohe;rty, and Martinson <br />And none voted against; <br />WIIEREUPON said resol.ution was declared duly passed and adopted. <br />Page 2 of 3 <br />
