Specifically, eliminating <br />the condition requiring the trash enclosure next to the building, instead opting for a <br />condition that allowed the trash enclosure as proposed by the applicant — in the southwest <br />corner of the site with coniferous landscaping, and a condition that required an <br />easement/agreement to be in place (recorded against both the Kimco property and the <br />Sports Authority property) pertaining to semi-truck access. <br />9.0 SUGGESTED CITY COUNCIL ACTION: <br />9.1 ADOPT a RESOLUTION APPROVING a CONDITIONAL USE PERMIT for <br />Kimco Realty and Starbucks Coffee allowing the development of a 2,000 sq. ft. stand <br />alone cafe/coffee shop near the southwest corner of the site at 1800 Highway 36, based on <br />the comments in Section 5, findings of Section 6, and the above revised conditions in <br />Section 7 of the project report dated February 26, 2007. <br />Prepared by: City Planner Thomas Paschke 651-792-7074 <br />Attachments: base map, aerial photo, and narrative. <br />PF07-009_RCA_022607.doc Page 6 of 6 <br />� <br />
