-1 <br />� <br />REQUEST FOR VARIANCE BOARD ACTION <br />Department Approval: <br />DATE: 8/1/2007 <br />ITEM NO: 4c <br />Agenda Section: <br />PUBLIC HEARINGS <br />Item Description: David Marks seeks VARIANCES to §1004 (Residence Districts) to <br />allow an expansion of the driveway that would encroach into the required <br />side yard setback and exceed the allowable impervious coverage on a <br />residential property at 984 Lydia Drive (PF07-040). <br />1.0 REQUESTED ACTION <br />1.1 Mr. Marks seeks variances to § 1004 (Residence Districts) of the City Code to allow an <br />expansion of the driveway that would encroach 4 feet into the required 5-foot side yard <br />setback and increase the impervious coverage on the property to approximately 31 % of <br />the overall lot area. <br />PROJECT REVIEW HISTORY <br />• Application submitted: June 26, 2007; Determined complete: July 18, 2007 <br />• Sixty-day review deadline: August 24, 2007 <br />• Project report recommendation: August 1, 2007 <br />• Anticipated Variance Board action: August 1, 2007 <br />2.0 SUMMARY OF RECOMMENDATION <br />2.1 The Planning Division recommends DENIAL OF THE REQUESTED VARIANCES to <br />§ 1004 of the City Code, but staff remains supportive of a variance for a less extensive <br />encroachment into the required side yard setback. See Section 5 of this report for further <br />information and Section 6 of this report for the detailed recommendation. <br />3.0 SUGGESTED ACTION <br />3.1 DENY THE REQUESTED VARIANCES, and ADOPT VARIANCE BOARD <br />RESOLUTION 65 APPROVING A VARIANCE to § 1004 of the City Code that is less <br />extensive than proposed but would still allow driveway improvements similar to the <br />proposal; see Section 7 below for details. <br />4.0 BACKGROUND <br />4.1 Mr. Marks owns the residential property at 984 Lydia Drive. The property has a <br />Comprehensive Plan designation of Low-Density Residential (LR) and a zoning <br />classification of Single-Family Residence District (R-1). <br />5.0 STAFF COMMENT <br />5.1 Section 1004.016 (Driveway Setbacks) of the City Code requires a minimum side yard <br />setback of 5 feet for driveways and parking areas.
