6.0 STAFF RECOMMENDATION <br />6.1 Based on the comments and findings outlined in Section 5 of this report, the Planning <br />Division recommends DENIAL of Mr. Marks's request for a 4-foot VARIANCE to the <br />side yard setback requirement established in §1004.016 (Driveway Setbacks) and a 75- <br />square-foot VARIANCE to the impervious surface area limit in §1004.1A(6) (Maximum <br />Total Surface Area) of the City Code. <br />6.2 The Planning Division further recommends APPROVAL of a 3-foot VARIANCE to the <br />side yard setback requirement established in � 1004.016 (Driveway Setbacks) to allow a <br />driveway expansion at 984 Lydia Drive, with the following conditions: <br />a. The driveway must maintain a side yard setback of at least 2 feet; <br />b. The impervious coverage on the property must comply with Code requirements. <br />This may be achieved by expanding the pavement consistent with the applicant's <br />previously-submitted site plan (Attachment E), except that the 22-foot-long <br />section of new pavement would be reduced to 20 feet; <br />c. The variance shall expire 6 months of the approval date if a building permit is not <br />issued, pursuant to § 1013.03 of the City Code. <br />7.0 SUGGESTED ACTION <br />7.1 ADOPT VARIANCE BOARD RESOLUTION 65 APPROVING A VARIANCE to <br />Section 1004 of the City Code that would allow Mr. Marks to expand the driveway, <br />based on the comments and findings of Section 5 and the conditions of Section 6 of the <br />project report dated August 1, 2007. <br />8.0 NEXT STEPS <br />8.1 The decision of the Variance Board is final unless an appeal is filed.
