� <br />Draft Resolution Attachment F <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the <br />City of Roseville, County of Ramsey, Minnesota, was held on the ls` day of August, <br />2007, at 5:00 p.m. <br />The following members were present: ; <br />Variance Board Member introduced the following resolution and moved its <br />adoption: <br />VB RESOLUTION NO. 66 <br />A RESOLUTION APPROVING A VARIANCE TO §905 (SWIMMING POOLS) <br />OF THE ROSEVILLE CITY CODE FOR SANTOS ESCOBAR, <br />175 BURKE AVENUE (PF07-043) <br />WHEREAS, Mr. Escobar has requested a VARIANCE to §905 (Swimming <br />Pools) of the Roseville City Code; and <br />WHEREAS, this property is addressed as 175 Burke Avenue, and legally <br />described as: <br />THORNTON'S SUBDIVISION OF THE NORTHEAST QUARTER OF SECTION <br />13 TOWNSHIP 29 RANGE 23, SUBJECT TO HIGHWAY, ROAD, AND <br />EASEMENTS, THE WEST 200.62 FEET OF THE SOUTH 95 FEET OF LOT 1 <br />PIN: 13-29-23-11-0145 <br />WHEREAS, Section 905.03A (Swimming Pool Location) requires minimum side <br />yard and rear yard setbacks of 10 feet for private swimming pools; and <br />WHEREAS, the Mr. Escobar seeks to encroach 5 feet into the side- and rear-yard <br />setbacks; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present <br />and support can be given to deviate from the strict requirements of the Roseville City <br />Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 5-foot VARIANCE to Section 905.03A of the City code, subject to the <br />following conditions: <br />1. The proposed pool must remain at least 5 feet from the eastern and southern <br />property lines and outside of the existing sanitary sewer easement on the <br />property; <br />Page 1 of 3 <br />
