Therefore the Planning Division has <br />concluded that the change in use is reasonable as is the requested VARIANCE. The <br />Planning Staff has determined that the property can be put to a reasonable use <br />under the official controls if a VARIANCE to Section §1004.015 is granted. <br />6.8 The pli¢ht of the landowner is due to circumstances uniaue to the propertv not <br />created bv the landowner: This pazcel is unique in a zoning sense. The business <br />zoning allows for residential uses but require a different set of development standards, <br />which in turn creates Code conflicts when being applied to a pre-existing structure. The <br />City of Roseville encourages reuse and redevelopment of aging, blighted properties, and <br />such situations will occur where applicants require variances in order to create viable <br />developments that have limited community impacts. The Planning Staff has <br />determined that the plig6t of the landowner is due to circumstances unique to the <br />property not created by the landowner. <br />6.9 The variance, if �ranted, will not alter the essential character of the localitv: The <br />Planning Staff has determined that supporting/approving a rear yazd building setback of <br />27 feet (3 foot vaziance) will not alter the essential chazacter of the locality, nor adversely <br />affect the public health, safety, or general welfaze, of the city or adjacent properties. <br />7.0 STAFF RECOMMENDATION: <br />7.1 The City Planner recommends approval of a 3-foot rear yard principal structure <br />setback VARIANCE to Section §1004.015 of the Rosevilie City Code allowing a pre- <br />existing building wall to be re-used as a component of the Pazkside Apartment <br />(redevelopment) project at 2560 Fry Street, based on the comments and findings in <br />Section 5 and the following conditions: <br />a. The rear yazd setback shall be limited to the pre-existing building wall location 27 <br />feet from the rear (east) property line. <br />b. Pazkside Apartment project shall meet all other requirements of § 1004.015 of the <br />Roseville City Code. <br />c. The vaziance (if granted) shall expire within 6 months of its approval if a building <br />permit is not issued (Section 1013.03). <br />8.0 SUGGESTED VARIANCE BOARD ACTION: <br />8.1 ADOPT RESOLUTION # APPROVING a 3 foot rear yard principal structure <br />setback VARIANCE to Section §1004A15 (Residential Dimensional Requirements) <br />of the Roseville City Code allowing the reuse/redevelopment of the Press Gym into the <br />Parkside Apartments, 2560 Fry Street, based on the comments in Section 5, the findings <br />of section 6, and the conditions of Section 7 of the project report dated August 1, 2007. <br />PF07-048_RVBA_080107.doc - Page 4 of 5 <br />
