�-. <br />.� <br />WHEREAS, Morrissey Development seeks to redevelop the existing commercial <br />building into Parkside Apartments, a 20-unit residential structure; and <br />WHEREAS, the zoning designation of R-3A "Multi-Family Residence District; <br />Three to Twenty-Four Units" specifies appropriate zoning requirements for the proposed <br />project; and <br />WHEREAS, Section 1004.016 (Building Setbacks) requires minimum rear yard <br />setback of 30 feet in the R-3A district; and <br />WHEREAS, the Morrissey Development seeks to encroach 3 feet into the <br />required rear yard setback; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 3-foot VARIANCE to Section 1004.016 of the City code, subject to the <br />following conditions: <br />1. The rear yard setback encroachment shall be limited to the pre-existing <br />building wall location 27 feet from the rear (east) property line; <br />2. Parkside Apartment project shall meet all other requirements of §1004.015 of <br />the Roseville City Code; and <br />3. Pursuant to § 1013.03 of the City Code, the VARIANCE shall expire 6 months <br />after the approval date if a building permit is not issued. � <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Member Martinson and upon vote being taken thereon, the following voted in favor: <br />Members Doherty, Gottfried, and Martinson. <br />And none voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />Page 2 of 3 <br />
