^ <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the <br />City of Roseville, County of Ramsey, Minnesota, was held on the 1 St day of August, <br />2007, at 5:00 p.m. <br />The following members were present: Vice Chair poherty and Members Gottfried <br />and Martinson <br />Variance Board Member poherty introduced the following resolution and moved its <br />adoption: <br />VB RESOLUTION NO. 68 <br />A RESOLUTION APPROVING A VARIANCE TO §1004 (RESIDENCE <br />DISTRICTS) OF THE ROSEVILLE CITY CODE FOR MORRISSEY <br />DEVELOPMENT, 2560 FRY STREET (PF07-048) <br />WHEREAS, Morrissey Development has requested a VARIANCE to § 1004 <br />(Residence Districts) of the Roseville City Code; and <br />WHEREAS, this property is addressed as 2560 Fry Street, and legally described <br />as: <br />SECTION 9 TOWNSHIP 29 RANGE 23 EXCLUDING THE NORTH 767 FEET <br />AND EXCLUDING THE SOUTH 335 FEET THE WEST 260 5/10 FEET OF THE <br />EAST 655 5/10 FEET OF THE NORTHEAST QUARTER OF THE NORTHEAST <br />QUARTER (SUBJECT TO ROAD) IN SECTION 9 TOWNSHIP 29 RANGE 23 <br />PIN: 09-29-23-11-0004 <br />WHEREAS, the property in question has a zoning designation of B-1, Limited <br />Business, which designation allows residential uses subject to the requirements of the <br />residential zoning designation appropriate for the proposed residential use; and <br />WHEREAS, Morrissey Development seeks to redevelop the existing commercial <br />building into Parkside Apartments, a 20-unit residential structure; and <br />WHEREAS, the zoning designation of R-3A "Multi-Family Residence District; <br />Three to Twenty-Four Units" specifies appropriate zoning requirements for the proposed <br />project; and <br />WHEREAS, Section 1004.016 (Building Setbacks) requires minimum rear yard <br />setback of 30 feet in the R-3A district; and <br />Page 1 of 3 <br />
