r

t 5.0 STAFF COMMENTS
^
_> 5.1 Joe Stranik, owner of the Midas service station, again seeks to re;paint the fascia and
update the signage. On any normal property, the paint colors would not require special
approvals, but because colors on this building have been explicit:ly approved (and
prohibited) by the City Council as part of the CUP, the City Council must also approve
t> changes to these colors.
, 5.2 Section 1013.O1H of the City Code allows administrative approval of minor amendments
s of Conditional Use Permits, but such "minor modifications" are defined as deviating less
:j than 10% from the originally approved standards. In this case, the request is for approval
f of a color change, which cannot be reasonably measured by percentages and so does not
strictly fit the definition of "minor modification".
7 5.3 Although an automobile service station in a Shopping Center (S••C) zoning district does
t 3 require a Conditional Use Permit, Community Development staif believes that regulating
t- the color of the fascia as part of the CUP is unnecessary.
>> 5.4
 t>
 ` 6.0
The current proposal also includes updates to the signage on the building. Any building
signs must comply with the signs requirements set forth in § 100! of the City Code.
STAFF RECOMMENDATION
3 6.1 Based in the comments and findings in sections 4 and 5 of this re;port, the Planning
Division recommends approval of the requested CONDITIONA:L USE PERMIT
2ta AMENDMENT for the Midas service station at 2168 Snelling A.venue, thereby affirming
' the use of the property as an auto service station in its present configuration and
"?_' eliminating the need to seek Council approval for future changes to paint colors.
 7.0 SUGGESTED CITY COUNCIL ACTION
2- 7.1 ADOPT A RESOLUTION approving the requested CONDITIO]vAL USE PERMIT
': AMENDMENT to affirm the use of the property as an auto service station and eliminate
? the need to seek Council approval for future changes to paint colors, based on the
2 comments of Section 6 of the project report dated May 7, 2007.
Prepared by:
Attachments
Associate Planner Bryan Lloyd (651-792-7073)
A: Area map
B: Site photos
C: Draft resolution
PF07-019 RCA 050707
