• <br />L� <br />REQUEST FOR COUNCIL ACTION <br />DATE: 6/1/07 <br />ITEM NO: <br />Department Approval: Agenda Section <br />Item Description: Request by Robert DeLeo for an INTERIM USE PERMIT to allow the <br />use of a recreational vehicle as temporary living quarters while the <br />permanent residence is being built at 280 Minnesota Avenue (PF07-024) <br />1.0 REQUESTED ACTION <br />2 1.1 Mr. DeLeo seeks approval of an INTERIM USE PERMIT in accordance with § 1012.09 <br />3 of the City Code to allow the use of a recreational vehicle (RV) as a temparary residence <br />4 during the construction of the new principal structure on the residential property at 280 <br />5 Minnesota Avenue. The temporary use began in May 2007 and is proposed to extend into <br />6 October 2007. <br />8 PROJECT REVIEW TIMELINE <br />9 Application submitted: April 16, 2007; determined complete: May 15, 2007 <br />10 60-Day review deadline: July 13, 2007 <br />11 Planning Commission public hearing & recommendation: June 6, 2007 <br />� 2 Anticipated City Council action: June 18, 2006 <br />� 3 2.0 <br />�� 2.1 <br />15 <br />16 3.0 <br />SUMMARY OF STAFF RECOMMENDATION <br />The Community Development Department recommends denial of the INTERIM USE <br />PERMIT request by Robert DeLeo. <br />PLANNING COMMISSION RECOMMENDATION <br />17 3.1 The Planning Commission reviewed the application at the public hearing on June 6, 2007 <br />18 and passed a motion (6-0) to recommend APPROVAL of the requested INTERIM USE <br />19 PERMIT, subject to certain conditions. <br />20 4.0 SUMMARY OF SUGGESTED ACTION <br />21 4.1 ADOPT A RESOLUTION DENYING the requested INTERIM USE PERMIT (see <br />22 Section 8 for detailed action). <br />23 5.0 BACKGROUND <br />24 5.1 Mr. DeLeo owns the property at 280 Minnesota Avenue; he recently razed the former <br />25 accessory structure and replaced it with a new detached garage, and he plans to build a <br />26 new home in the same general location as the former residence.
