--. --- WHEREAS, the existing principal structure is 2.8 feet from the southern property line, requiring a 7.2-foot variance; and WHEREAS, Section 1004.016 (Driveway Setbacks) requires a 5-foot driveway setback from a side property line; and WHEREAS, Mr. and Mrs. Kurtz seek to reduce the existing driveway to achieve a setback of 2.8 feet along the southern property line, requiring a 2.2-foot variance, which distance is consistent with the nonconforming setback of the existing principal structure; and WHEREAS, the Planning Division has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to APPROVE a 7.2-foot VARIANCE to Section 1004.016 of the City Code AND a 2.2-foot VARIANCE to Section 1004.016 of the City Code, subject to the following conditions: 1. Pavement serving the garage must achieve a separation of at least 2.8 feet from the southern properiy line prior to January 1, 2008; 2. The width of the driveway at the front property line must be limited to 26 feet, pursuant to §703.04B (Driveway Standards) of the City Code; 3. Because §602.04 (Parking on Boulevard Prohibited) of the City Code prohibits the creation of a parking space on the part of a driveway that lies within a street right-of-way, the un-permitted concrete parking space that has been recently paved in the South Owasso Boulevard right-of-way must removed prior to January 1, 2008; and 4. The variance shall expire 6 months from the approval date if an appropriate driveway permit is not issued, pursuant to § 1013.03 of the City Code. The motion for the adoption of the foregoing resolution was duly seconded by Member Boerigter and upon vote being taken thereon, the following voted in favor: Boerigter, Martinson, and Doherty. And none voted against; WHEREUPON said resolution was declared duly passed and adopted. Page 2 of 3
