--. --- <br />WHEREAS, the existing principal structure is 2.8 feet from the southern property <br />line, requiring a 7.2-foot variance; and <br />WHEREAS, Section 1004.016 (Driveway Setbacks) requires a 5-foot driveway <br />setback from a side property line; and <br />WHEREAS, Mr. and Mrs. Kurtz seek to reduce the existing driveway to achieve a <br />setback of 2.8 feet along the southern property line, requiring a 2.2-foot variance, which <br />distance is consistent with the nonconforming setback of the existing principal structure; <br />and <br />WHEREAS, the Planning Division has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 7.2-foot VARIANCE to Section 1004.016 of the City Code AND a 2.2-foot <br />VARIANCE to Section 1004.016 of the City Code, subject to the following conditions: <br />1. Pavement serving the garage must achieve a separation of at least 2.8 feet <br />from the southern properiy line prior to January 1, 2008; <br />2. The width of the driveway at the front property line must be limited to 26 feet, <br />pursuant to §703.04B (Driveway Standards) of the City Code; <br />3. Because §602.04 (Parking on Boulevard Prohibited) of the City Code <br />prohibits the creation of a parking space on the part of a driveway that lies <br />within a street right-of-way, the un-permitted concrete parking space that has <br />been recently paved in the South Owasso Boulevard right-of-way must <br />removed prior to January 1, 2008; and <br />4. The variance shall expire 6 months from the approval date if an appropriate <br />driveway permit is not issued, pursuant to § 1013.03 of the City Code. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Member Boerigter and upon vote being taken thereon, the following voted in favor: <br />Boerigter, Martinson, and Doherty. <br />And none voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />Page 2 of 3 <br />
