the former home on May 22, 2007, Mr. DeLeo lias been residing in the RV on the <br />property and is requesting fonnal approval of an Interim Use Permit (IUP) to legitimize <br />the temporary living quarters that would remain on the property until occupancy of the <br />new home is permitted. <br />5 5.2 The DeLeo property is zoned R-1, Single Family Residence District, with a <br />E Comprehensive Land Use Map designation of LD, Low Density Residential, which <br />r designations do support the proposed temporary use. <br />8 53 The application materials indicate that the temporary residence would consist of a 29-foot <br />9 self-contained RV that would stand in front of the new garage, which would provide <br />�t o water, electricity, and telephone service. <br />1 i 6.0 STAFF COMMENTS <br />12 6.1 The City Code allows garages on residential properties as accessory to the principal use <br />13 (i.e., the residence itsel�, and as such prohibits habitation in garages. And the Code <br />14 prohibits, by omission, the use of RVs as dwellings, even temporarily. <br />15 6.2 Mr. DeLeo plans to have water and sanitary sewer lines serving his new garage and had <br />16 frequently expressed his desire to live in his garage during the construction of his new <br />17 home; for a variety of health and safety reasons, the Building Official and inspectors have <br />18 repeatedly informed Mr. DeLeo that this cannot be allowed. <br />19 6.3 Accompanying Mr. DeLeo's persisting interest in living in his garage is the fact that the <br />2o former house was razed as of May 22, 2007. It came to light at the June 6, 2007 Planning <br />21 Commission meeting that the RV was already in use as the temporary residence, but Mr. <br />22 DeLeo was aware before the demolition of his home that City staff did not support either <br />23 of the on-site possibilities. <br />24 6.4 Section 1012.09A of the City Code indicates that "the City Council may authorize an <br />25 Interim Use Permit [for] land uses that fail to meet all of the zoning standards established <br />26 for the district within which it is located". Such approval is not required, however, and is <br />27 left to the discretion of City officials. <br />28 6.5 An IUP far using an RV as an on-site temporary residence during the construction of a <br />29 new home was considered and approved for the first time in May 2006 for Jim Alexander <br />30 (920 Parker Avenue). Conditions of the approval of this IUP included requirements for <br />31 the location of the RV during construction and after its completion, an expiration date of <br />32 the IUP, and requirements for providing the RV with electricity, water, and "sewer" <br />33 service. <br />34 6.6 While Mr. Alexander was very cooperative in his efforts to comply with the conditions of <br />35 the ICJP approval, Community Development staff still found it difficult to ensure that the <br />36 RV would function adequately as a temporary residence — especially during severe storins <br />37 or extreme temperatures.
