Owasso Boulevard Reconstruction Project <br />Non-conforming driveway <br />Dear Mr and Mrs. Kurtz; <br />• <br />I wanted to provide for you a follow up letter regarding your Non- conforming driveway. At this <br />time I have reviewed the following attached documents: <br />1. Request for Council action dated 4/10/95 <br />2. Survey dated 5/5/95 by EG Rud and Sons (showing both lots) <br />3. Final Grading plan dated 5/2/95 by EG Rud and Sons showing entire development. <br />4. Survey dated 10/26/95 by EG Rud and Sons. (3015 S. Owasso Blvd) <br />5. Deed signed by Chester and Joann Kurtz on 5/9/96 <br />6. Survey dated 8/26/96 by EG Rud and Sons. (3005 S. Owasso Blvd) • <br />7. Ramsey County Parcel information including filed legal description. (3/24/06) <br />The minor subdivision that created these two lots was approved in 1995 as a part of the Owasso <br />Hills Planned Unit Development (PF 2725). The legal descriptions and accompanying drawings <br />on document numbers l, 2, 3, 5, & 7 are the same. All documents, plats, and surveys that were <br />presented to the Council as a part of this approval process represent the lot split with the same <br />legal description that exists today at the County. This same legal description was also on the <br />deeds you faxed to me yesterday. According to these documents your driveway encroaches onto <br />you neighbor's property by approximately 10 feet <br />The two surveys (numbers 4& 6 above) that you provided to me at our meeting last Friday show <br />a different legal description as well as property line. If you will recall, these drawings represent <br />that the lot line is located 7.48 feet further south than the legal description filed at Ramsey <br />County. <br />We have discussed the matter with the City Attorney, he has advised me that your driveway <br />encroachment is a private property issue that is up to you to resolve with your neighbor. If it <br />does not get resolved it may create an issue when you go to sell your home in the future.
