• <br />� <br />Attachment K <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Gouncil of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 23r1 day of July, 2007, at 6:00 p.m. <br />The following members were present: <br />and were absent. <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A VARIANCE TO §1004 OF THE ROSEVILLE CITY <br />CODE FOR JOANN KURTZ AT 3015 SOUTH OWASSO BOULEVARD (PF07-036) <br />WHEREAS, Joann Kurtz is the owner of property at 3015 South Owasso Boulevard; and <br />WHEREAS, the subject property is legally described as: <br />NEEDS LEGAL DESCRIPTION <br />PIN: 01-29-23-12-0068 <br />WHEREAS, Section 1004.016 (Driveway Setbacks) of the Roseville City Code requires <br />a 5-foot setback from side property lines for driveways in the Single-Family Residence Zoning <br />District; and <br />WHEREAS, Joann Kurtz seeks to allow pavement to encroach up to 4 feet into the <br />required setback; and <br />WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br />requested VARIANCE, voting 6-0 to recommend approval of the request based on the comments <br />and iindings of the staff report dated July 11, 2007; and <br />WHEREAS, the Roseville City Council has determined that hardships exist and that <br />approval of the requested VARIANCE will not compromise the health, safety, and general <br />welfare of the citizens of Roseville; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Joann Kurtz for a VARIANCE to Section 1004A 16 (Driveway Setbacks) of the <br />Roseville City Code subject to the following condition; <br />1. Pavement serving the Kurtz garage must be removed to achieve a separation of at <br />least 1 foot from the new property line by September 28, 2007. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member and upon vote being taken thereon, the following voted in favor <br />PaDe I of 3 <br />
