The lot line correction will place the property boundary on the <br />proper side of the driveway, but a variance will still be required to account for the <br />substandard setbacks of the existing garage and driveway from the relocated property <br />line. <br />� 2.0 SUMMARY OF STAFF RECOMMENDATION <br />� 2.1 The Planning Division recommends approval of the proposed LOT LINE CORRECTION <br />� t� AND VARIANCE to Section 1004.016. <br />i t 3.0 PLANNING COMMISSION RECOMMENDATION <br />�� 3.1 On July 11, 2007, the Planning Commission held the public hearing for this land use <br />�; application. Upon reviewing the application and seeking public comment, the Planning <br />�� Commission voted 6-0 to recommend approval of the requested LOT LINE <br />> > CORRECTION AND VARIANCE <br />�� 4.0 <br />i , 4.1 <br />l� <br />SUMMARY OF SUGGESTED ACTION <br />APPROVE the proposed LOT LINE CORRECITON AND VARIANCE (see Section 8 <br />for detailed action). <br />i 9 5.0 BACKGROUND <br />�u 5.1 The original survey and legal descriptions for these two properties (Parcels "A" and "B"), <br />2� prepared by E. G. Rud & Sons and dated May 5, 1995, were approved as a Minor <br />?2 Subdivision and subsequently recorded at Ramsey County. <br />z� <br />,,� <br />n; <br />2 Ci <br />?7 <br />�� <br />� �� <br />5.2 Another survey for Parcel "A" (dated October 26, 1995 by E. G. Rud & Sons) was <br />submitted with the building permit application for the Kurtz property (Permit <br />#A9501198); this survey indicated property boundaries and legal descriptions that <br />differed from those that were previously approved by the City Council and filed in the <br />Ramsey County Recorder's office.
