Community Development Department <br />651-792-7074 ♦ fax: 651-792-7070 <br />Based on the surveys and the information contained therein, both principle structures met <br />the required setbacks established in Section 1004.016 of the Roseville City Code. <br />However, there is no plan or permit for the Kurtz driveway so it is unclear whether the <br />City approved its location and/or installation. Therefore a determination on compliance <br />with the City Code can not be completed. <br />On or about May 22, 2007 I received a Certificate of Survey by E. G. Rud & Sons dated <br />November 21, 2006 regarding the Kurtz and Barrett properties. Specifically this survey <br />was created to address the Kurtz driveway encroachment on to the Barrett property. The <br />survey indicates that the Kurtz attached garage was constructed 2.8 feet from the south <br />property line (that property line shared with the Barrett parcel); a driveway that is <br />constructed over the property line (shared with the Barrett's) by 7.4 feet on the east and <br />to 12.4 feet on the west; and a garage addition constructed approximately 6 feet from the <br />south property line. <br />The Minor Subdivision survey of October 26, 1995 and the Certificate of Survey dated <br />November 21, 2006 indicates exactly the same lot dimensions. Staff can only reach the <br />conclusion that the Kurtz home was incorrectly staked on the parcel. This inadvertent <br />occurrence has created two specific non-conformities (principal structure and driveway <br />setbacks) and the property encroachment. <br />The Planning Staff has concluded that a MINOR SUBDIVISION, under the Correction <br />section of the Code, as supported on the survey of November 21, 2006, and a <br />VARIANCE, for the driveway and attached garage setback encroachments, is required to <br />resolve this outstanding matter. <br />Attached please find the MINOR SUBDNISION and VARIANCE applications and a Land Use <br />Application schedule. Please complete both applications and submit them with all required <br />materials and fees. Since I am in possession of the Certificate of Survey this document is not <br />necessary.
