PROJECT REVIEW HISTORY • Application submitted: July 6, 2007; Determined complete: July ] 0, 2007 • Sixty-day review deadline: September 4, 2007 • Project report recommendation: August 1, 2007 • Anticipated Planning Commission action: August 1, 2007 • Anticipated City Council action: August 27, 2007 2.0 SUMMARY OF STAFF RECOMMENDATION: 2.1 The Planning Division recommends approval of the requested RIGHT-OF-WAY VACATION, subject to certain conditions; see Section 6 of this report for details. 3.0 SUMMARY OF SUGGESTED ACTION: 3.1 By motion, recommend approval of the requested RIGHT-OF WAY VACATION, pursuant to § 1013.04 (Right-Of-Way Vacation) of the City Code, subject to conditions; see Section 7 of this report for details. 4.0 BACKGROUND: 4.1 Mr. Livingston owns the property at 2574 Dunlap Street, which has a Co�nprehensive Plan designation of Low-Density Residential (LR) and a zoning classification of Single- Family Residence District (R-1). 4.2 Even though Rose Place is not a through street, the applicant's property is considered a corner lot because it lies at the southwest corner of the intersection of the Rose Place and Dunlap Street Rights-Of-Way; the requested ROW vacation would move the side property line (and the related setback line) further north, thereby increasing the lot size and expanding the build-able area of the property.
