Draft Resolution Attachment F <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the <br />City of Roseville, County of Ramsey, Minnesota, was held on the 6`" day of June, 2007, <br />at 5:30 p.m. <br />The following members were present: ; <br />Variance Board Member introduced the following resolution and moved its <br />adoption: <br />VB RESOLUTION NO. 69 <br />A RESOLUTION APPROVING A VARIANCE TO §1012 (GENERAL <br />REQUIREMENTS) OF THE ROSEVILLE CITY CODE FOR NICHOLAS AND <br />JANET KING, 1728 LINDY AVENUE (PF07-049) <br />WHEREAS, Mr. and Mrs. King have requested a VARIANCE to § 1012 (General <br />Requirements); and <br />WHEREAS, this property is addressed as 1728 Lindy Avenue, and is legally <br />described as: <br />FAIRVIEW HEIGHTS PLAT 3, LOT 12 BLOCK 6 <br />P I N : 15-29-23-44-0019 <br />WHEREAS, Section 1012.02B(3) (Side Yard Encroachments) allows fences up to <br />6.5 feet in height in the side and rear yards on residential lots; and <br />WHEREAS, the Kings seek to install an 8-foot-tall fence along their side and rear <br />property lines; this requires a 1.5-foot height variance; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present <br />and support can be given to deviate from the strict requirements of the Roseville City <br />Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 1.5-foot VARIANCE to Section 1012.02B(3) of the City code, subject to <br />the following conditions: <br />1. The the 8-foot-tall fence must not extend closer than 40 feet from the front <br />property line. <br />2. Pursuant to § 1013.03 of the City Code, the VARIANCE shall expire 6 months <br />after the approval date if a fence permit is not issued. <br />Page 1 of 3 <br />� • <br />
