'"� <br />� <br />WHEREAS, Section 1004.016 (Residential Setbacks) requires a 30-foot principal <br />structure setback from a front property line; and <br />WHEREAS, Ms. Mueller seeks to construct a principal structure addition 14 feet <br />from the front property line, requiring a 16-foot variance, which distance is consistent <br />with the legal nonconforming setback of the existing principal structure; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE an 8-foot VARIANCE to Section 1004.016 of the City Code AND a 16-foot <br />VARIANCE to Section 1004.016 of the City Code, subject to the following conditions: <br />1. The size and location of the proposed attached garage must be consistent with <br />the site plan reviewed with this application. It must not encroach more than 8 <br />feet into the required 30-foot setback from the property line adjacent to <br />Cohansey Boulevard nor be closer than 14 feet to the front property line; <br />2. The proposed improvements must not cause the overall impervious coverage <br />to exceed 30% of the lot area; <br />3. The existing driveway shall be removed and the detached garage shall not <br />thereafter be used for the storage of daily-use vehicles; and <br />4. Pursuant to § 1013.03 of the City Code, the VARIANCE shall expire 6 months <br />after the approval date if a building permit is not issued. <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Member Martinson and upon vote being taken thereon, the following voted in favor: <br />Boerigter, Doherty, and Martinson <br />And none voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />Page 2 of 3 <br />
