6.0 STAFF RECOMMENDATION <br />6.1 Based on the comments and findings outlined in Section 5 of this report, the Planning <br />Division recommends APPROVAL of the Livingstons' request for a VARIANCE to the <br />required setback from a side property line adjacent to a public right-of-way, established <br />in § 1004.016 (Residential Setbacks) of the City Code, to allow the construction of the <br />proposed garage at 2578 Dunlap Street, subject to the following conditions: <br />a. The size and location of the accessory structure must be consistent with the <br />survey dated July 10, 2007. If an expansion of the attached garage is preferred, <br />the principal structure shall remain at least 1 foot from the northern property line; <br />b. The proposed improvements must not cause the overall impervious coverage to <br />exceed 30% of the lot area; <br />c. The existing shed must be removed from the property or relocated to a Code- <br />compliant location on the property prior to the final building inspection; and <br />d. The variance shall expire 6 months from the approval date if a building permit is <br />not issued, pursuant to § 1013.03 of the City Code. <br />7.0 SUGGESTED ACTION <br />7.1 ADOPT VARIANCE BOARD RESOLUTION 71 APPROVING THE <br />REQUESTED VARIANCE to Section 1004 of the City Code to allow the proposed <br />improvements at 2574 Dunlap Street, based on the comments and findings of Section 5 <br />and the conditions of Section 6 of the project report dated October 3, 2007. <br />8.0 NEXT STEPS <br />8.1 The decision of the Variance Board is final unless an appeal is filed.
