1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />l2 <br />13 <br />a) Curbs proposed to be replaced shall have a minimum of 3 feet of biturninous saw cut <br />out to allow for proper compaction. <br />b) Utility trenches shall be restored by the Developer per City standard plate No. 3. <br />Utility Trench Restoration (typical pavement 5 years old to 5 year project). <br />7. Erosion control. Prior to site grading and before any utility construction is commenced <br />or building permits are issued, the erosion control plan shall be implemented, inspected <br />and approved by the Cit�. The Developer shall meet all requirements of the City's <br />Erosion Control Ordinance including but not limited to the following. <br />a) No construction activity shall be allowed and no building permits shall be issued <br />unless the plat is in full compliance with the erosion control requirements. <br />b) Measures shall be installed in compliance with MPCA NPDES permit requirements. <br />c) The City shall inspect the site periodically and determine whether it is necessary to <br />take additional measures to address erosion. <br />14 d) To remove dirt and debris from streets that has resulted from construction work by <br />t 5 the Developer, its agents or assigns, the Developer shall sweep Acorn Road and <br />16 County Road B on a weekly basis or more frequently as directed by the City Engineer <br />17 until the site is stabilized. Developer must sweep roadwa.ys with a water-discharge <br />� 8 broom apparaius. Kick-off brooms shall not be utilized for street sweeping. <br />l9 e) If the plat development dces not comply with the erosion control plan and schedule or <br />2p supplementary instructions received from the City, after the Developer has received <br />21 48-houz verbal notice, the City may take such action as it d�ems appropriate to <br />2Z control erosion. <br />23 <br />24 <br />25 <br />26 <br />27 <br />2s <br />29 <br />30 <br />31 <br />32 <br />33 <br />34 <br />35 <br />3b <br />37 <br />38 <br />39 <br />fl The City will endeavor to notify the Developer in advance of any proposed action but <br />failure of the City to do so will not affect the Developer's or the City's rights or <br />obligations hereunder. If the Developer does not reimburse the City for costs <br />incurred hereunder within thirty (30) days, the City may draw down the letter of <br />credit to pay any costs. <br />D. Development Plans. The plat shall be developed in accordance with the following plans. <br />The plans shall not be attached to this Contract. With the exception of the plat, the plans may <br />be prepared, subject to City approval, after entering the Contract, but before commencement <br />of any work in this plat. If the plans vary from the written terms of this Contract, the written <br />terms shall control. T'he plans are: <br />a) Plat <br />b) Utilify Plan <br />c) Grading, Drainage and Erasion Control Plan <br />d) Grading Notes and Details <br />e) Street Sarutary sewer and Watermain Details <br />£� Tree Preservation Plan <br />g) Sanitary sewer, watermain, storm sewer and street plan. <br />Page 3 of 10 <br />• • <br />
