� <br />C) <br />� <br />Document# 4170814 <br />Recorded 0711712009 1600 <br />County Recorder, Ramsey County, MN <br />2.4.6 452945 <br />VARIANCE TERMINATION <br />A DOCUMENT TERMINATING VARIANCES TO §1012 (GENERAL <br />REQUIREMENTS) AND §703 (REGULATION OF PUBLIC WAYS) OF THE <br />ROSEVILLE CITY CODE FOR EMILY TAMURA, 1000 WOODHILL DRIVE <br />(PFO&003) <br />Legal Description: <br />Reiling Park No. 2 excluding the east 12 feet of Lot 2 Block 2 <br />PIN:02-29-23-33-0056 <br />WHEREAS, Section 1012.01 B(Alternative Lot Requirements) of the City Code <br />requires a 5-foot principal structure setback from the side property line; and <br />WHEREAS, Section 703.04 (Driveway Standazds) of the City Code requires a 5- <br />foot driveway setback from a side property line; and <br />WHEREAS, the Roseville Variance Boazd adopted Resolution No. 76, on the 6`� <br />day of February, 2008, approving a 3-foot VARIANCE to Section 1012.01 B of the City <br />Code and a 3-foot VARIANCE to Section 703.04 of the City Code, subject to the <br />following conditions: <br />1. The size and location of the proposed addition shall be consistent with the <br />plans reviewed with this application and shall not reduce the side yazd setback <br />to less than 2 feet, and; <br />2. Any expansion of the driveway shall remain at least 2 feet from the side <br />property line and shall not exceed 26 feet in width at the front property ]ine, <br />and; <br />3. Pursuant to § 1413.03 of the City Code, the VARIANCE shall expire 6 months <br />after the approval date if a building permit is not issued. <br />And WHEREAS, building permits were not issued within 6 months of the date of <br />the VARIANCE approval as required in Condition 3; <br />NOW THEREFORE BE IT DETERMINED that the VARIANCES approved by <br />said Variance Boazd Resolution No. 76 has expired. <br />Page 1 of 2 <br />
