vARIANCE will not alter the essential character of the locality, nor adversely affect <br />the public health, safety, or general welfare of the city or adjacent properties. <br />6.O STAFF RECOMMENDATION <br />6.1 Based on the comments and findings outlined in Section 5 of this report, the Planning <br />Division APPROVAL of a 9-foot vARIANCE to the side yard setback requirement <br />established in § 1004.016 (Driveway Setbacks) to allow the proposed principal structure <br />expansion at 2271 Marion Street, with the following conditions: <br />a. The size and location of the proposed addition shall be consistent with the plans <br />reviewed with this application and shall not be less than 18 feet from the northern <br />side property line; <br />b. The driveway must comply with all applicable requirements; <br />c. The impervious coverage on the property must not exceed 30% of the overall <br />property area; and <br />d. The variance shall expire 6 months of the approval date if a building permit is not <br />issued, pursuant to § 1013.03 of the City Code. <br />'%.O SUGGESTED ACTION <br />7.1 ADOPT VARIANCE BOARD RESOLUTION 78 APPROVING A VARIANCE to <br />Section 1004 of the City Code that would allow Mr. Johnson to expand the principal <br />structure, based on the comments and findings of Section 5 and the conditions of Section <br />6 of the project report dated March 5, 2008. <br />g.O NEXT STEPS <br />8.1 The decision of the Variance Board is final unless an appeal is filed.
