s �— <br />—� <br />�. <br />REQUEST FOR VARIANCE BOARD ACTION <br />Approval: <br />DATE: 3/5/2008 <br />ITEM NO: 4a <br />Agenda Section: <br />PUBLIC HEARINGS <br />Item Description: Request by James Johnson, 2271 Marion Street, for VARIANCES to <br />§1004 (Residence Districts) to allow a principal structure encroachment <br />into the required setback from a side property line, impervious coverage <br />exceeding allowable limits, and more garage area than Code allows <br />(PF08-007) <br />1.0 REQUESTED ACTION <br />1.1 Mr. Johnson seeks a variance to § 1004 (Residence Districts) of the City Code to allow an <br />expansion of the principal structure that would encroach 9 feet into the required setback <br />froin a side property line adjacent to a street right of way. <br />1.2 The published notice for this public hearing indicated that a variance was also being <br />sought for excess garage area, but Planning Division staff has since detennined that the <br />proposal does not cause the garage to exceed Code allowances; therefore, a variance to <br />this limit is not being considered. <br />1.3 The published notice also indicated that a variance was being sought for excess <br />impervious coverage to allow for additional driveway area. While the applicant may still <br />desire a larger driveway, Planning Division staff has determined that a reasonable <br />driveway coniiguration exists that does not exceed Code allowances, and does not <br />support such a variance.
