PLANNING FILE OS-008 <br />Request by Michael Schueller, in conjunction with properry owners Catherine and Riaz Hussain, <br />, for approval of an INTERIM USE PERMIT to allow a deli and catering facility at 1901 Lexington <br />Avenue <br />� Chair Bakeman opened the Public Hearing for Planning File 08-008. <br />� Mr. Lloyd reviewed the request of Michael Schueller for an INTERIM USE PERMIT to allow a deli and <br />catering facility in the existing building at 1901 Lexington Avenue, in accordance with Roseville City Code, <br />3 Section 1012.09 (Interim Uses). <br />a Mr. Lloyd reviewed previous Planning Commission action for approval of a rezoning request for the <br />i o property; and ultimate City Council denial of the rezoning, tabling the item and encouraging the applicant <br />i' to withdraw that application and work with staff to devise another way of permitting the desired uses on <br />iz the property without opening it up to other traffic-intensive uses allowed in a B-1B District in the future. <br />i:; Mr. Lloyd noted that the City Council identified a zoning text amendment of PUD as desired applications <br />ia for uses that they could possible support, with staff ultimately reviewing those options with the City <br />i:, Attorney, determining that neither would be appropriate for the current purposes. Mr. Lloyd advised that <br />i a an IUP application seemed the most appropriate way to temporarily allow the deli and catering use on the <br />i � property until a comprehensive update of the City's Zoning Ordinance could be completed. <br />ie Staff recommended APPROVAL of the requested INTERIM USE PERMIT, for Michael Schueller, in <br />i 7 conjunction with property owners Catherine and Riaz Hussain, to allow a deli and catering facility at 1901 <br />a;i Lexington Avenue, based on the comments and findings detailed in Sections 4, 5 and 6, and conditions <br />?' outlined in Section 7 of the Project Report dated March 5, 2008. <br />__ Discussion included the process for renewing an Interim Use Permit, with staff advising that the applicant <br />z:� would need to go through the Permitting process again; and rationale for staff recommending a three-year <br />2-i term for the Permit, with staff indicating that this was the anticipated timeframe for updating the City's <br />z: zoning ordinance. <br />%.� Applicant, Michael Schueller <br />27 Mr. Schueller concurred with staff's report; noting that it was their intent to close by 7:00 p.m. each <br />�3 evening, with their main business during the lunch hour, in an effort to accommodate neighbors. <br />2? Chair Baker asked Mc Schueller if he was comfortable with the proposed three year timeframe. <br />3o Mr. Schueller admitted that he was somewhat uncomfortable with that timeframe, but eager to get their <br />3' business opereting, and confident that revisions would be made to the zoning code during that timeframe. <br />Mr. Lloyd advised that staff had received public comment from two (2) residents along Autumn Street, <br />�.� both in opposition to the project. Mr. Lloyd noted that one was simply opposed to the project in general, <br />:� while the other party raised safety issues for children in the neighborhood and increased tra�c specific to <br />�,s this project. <br />35 Public Comment <br />3 i Patrick Schmidt, 1140 Autumn Street, FAST (Foes of Autumn Street Traffic) <br />�ri Mr. Schmidt presented written comments, dated March 5, 2008, representing FAST (Foes of Autumn <br />3;; Street Traffic), attached hereto and made a pait thereof. <br />�o Carolyn Bolen, 1120 Autumn Street <br />� Ms. Bolen expressed concem and confusion regarding a pick-up window or drive-thru, and wanted <br />t � clanfication. <br />::� Chair Bakeman clarified the difference between the two, and assured Ms. Bolen that the staff <br />a z recommendation did not indude a drive-thru. <br />as Ms. Bolen expressed further concern regarding parking on Autumn Street, noting that she was concerned <br />a> that vehicles would utilize adjoining neighbor driveways, and additional on-street parking would create <br />n further safety issues. <br />�s3 Staff clarified that streets, if not designated and posted "No Parking" were public domain; but clarified that <br />a� the only access for this project would be on Lexington Parkway. <br />�o Ms. Bolen also questioned the location of proposed landscaping. <br />
