i�% <br />11;: <br />6.7 Two residents on Autumn Street provided brief written statements of opposition prior to <br />the public hearing. Two more members of the public addressed the Planning Commission <br />during the hearing, expressing some apprehension about the request, but not opposing it. <br />One of the people who spoke at the public hearing documented the same issues about <br />which he spoke in a letter he submitted on behalf of "FAST -Foes of Autumn Street <br />Traffic", although he noted that FAST likely does not represent the views of as many <br />neighbors as it may once have. <br />7.0 RECOMMENDATION <br />� ��+ 7.1 After reviewing the application and soliciting public comment and question at the public <br />�2r, hearing, the Planning Commission voted 5-0 to recommend approval of the requested <br />12 INTERIM USE PERMIT. <br />� 2� 7.2 Because Mr. Schueller will not yet own the property by the date of the City Council's <br />� 2�> decision, the applicant and the representative of the property owner expressed the desire <br />� 2- to have the expiration of an approved IUP coincide with the date of the property transfer. <br />� 2= If the requested IUP is approved, Planning Division staff recomends making it valid from <br />�zt June 1, 2008 through May 31, 2011 in order to allow time for the property closing. <br />12 � 7.3 Consistent with the recommendation of the Planning Commission and based on the <br />� 2� comments and findings detailed in Sections 4, 5, and 6 of this report, the Planning <br />� 2<� Division recommends approval of the requested IUP, subject to the following conditions: <br />� 3!; a. Screening consistent with that contemplated in § 1005.01 G(Buffer Zones) of the City <br />�:3 Code shall be installed along the western property line to the Community <br />� 3:_ Development Director's approval; <br />� 3; b. The applicant shall provide a landscape plan for the property to ensure that the plants <br />� 3�. and landscape features installed on the property are able to achieve compliance with <br />�3� City Code requirements pertaining to screening and traffic safety; <br />� <br />8.0 <br />c. This approval shall not be construed to allow a drive-through facility; and <br />d.
