� <br />��� <br />.��' <br />October 20, 2009 <br />Mr. Riaz Hussain <br />2333 Maple Lane East <br />Maplewood, MN 55109-1538 <br />RE: 1901 Lexington Avenue, Roseville <br />Mr. Hussain, <br />-.. <br />On October 19, 2009 you addressed the Roseville City Council and expressed your desire to attempt to <br />amend the Conditional Use Permit approved for your property in 1997 to remove the condition that gives <br />the city the discretion to declare the driveway/parkway unsafe and also ask the City Council to rescind its <br />decision from 2008. Planning Division staff would not support such an amendment to the Conditional <br />Use Permit, and it will be for you to state the case for changing or eliminating the existing requirement to <br />remove the driveway/parking areas along Autumn Street. Nevertheless, you do have the ability to ask for <br />this to be considered. The application fee for this request is $600.00 and will require a public hearing at <br />the Planning Commission with the surrounding neighborhood notified of the meeting and your request. <br />After a recommendation is made by the Planning Commission, the City Council will then consider the <br />request. <br />On multiple occasions in the past year and a half, the City Council has affirmed to staff and to you its <br />decision that the parking areas in question are to be removed, and we are responsible for working with <br />you to achieve compliance with that requirement. To that end, please complete the enclosed Conditional <br />Use Application form and return it - along with the other supporting materials and information identified <br />on the application form - to the Community Development Department by 4:30 p.m. on Friday, November <br />6, 2009 so that we may bring the application to the Planning Commission at its December 2"d meeting.
