KB) <br />(Here's the complete version of the draft I accidentally sent <br />earlier.) <br />Ms. Samec, <br />I've talked with the City Engineer, Deb Bloom, about the surveys you sent, and there <br />appear be some remaining issues to resolve before the request to vacate the Walnut Street <br />right-of-way (ROw) can be brought to the City Council for approval. <br />As you may have read in the email that I originally sent to Sandra Nelson in your office <br />(who subsequently forwarded the message to you), the Planning Commission recommended <br />vacating the portion of the Walnut Street ROW that overlaps Midland Hills' property as the <br />City understands the property boundaries. The "Site Plan" PDF attached to this email <br />represents the relevant Midland Hills property lines according to City and County records <br />(in blue), the pavement of State Highway 280 and the recently-closed access road (in <br />grey), and the Walnut Street ROW as represented in the surveys provided by Midland Hills <br />(in red); this is something I cobbled together by tracing the different layers of <br />informaiton onto one site plan so, while it isn't survey quality, it's accurate enough for <br />illustration purposes. In the site plan, the red-shaded area illustrates the portion of <br />the ROW that City staff and the Planning Commission have recommended for vacation. The <br />significant difference between this site plan and the latest survey provided to the City <br />is at the north end of the ROW; the applicant's survey still shows the area to be vacated <br />as extending all the way to Highway 280. <br />If the City and County records of the property boundaries are accurate as shown in the <br />attached site plan, then Midland Hills needs to supply a legal description corresponding <br />to the red-shaded area in that PDF; this is the portion of the ROW that overlaps the golf <br />course property and that has been recommended for vacation. A digital copy of the staff <br />report that was reviewed by the Planning Commission prior to making their recommendation <br />is also attached to this email for your reference. But even if the Midland Hills property <br />actually does extend all the way to the edge of Highway 280, the Public Works Director and <br />the Planning Commission only recommended vacating the ROW shaded in red on the attached <br />site plan - because the (un-shaded) remainder of the ROW may be needed in the future for <br />utilities or expansion of the highway - and the applicant would still need to provide the <br />legal description corresponding to the area recommended for vacation. <br />The application for the requested ROW vacation was received on January 31, 2008, and the <br />60-day deadline for final action by the City expires on March 31, 2008. Since there is no <br />longer time to provide the City Council with the information needed make a decision at the <br />March 24th meeting as originally expected, it will have to wait until the next city <br />Council meeting which is scheduled for April 14, 2008. For this reason, it is necessary to <br />extend the action deadline by an additional 60 days pursuant to MN Statute 15.99 subd. 3f; <br />nevertheless, City staff remains committed to requesting City Council action on the <br />application as soon as possible after receiving the required information. <br />Please contact Deb Bloom (651-792-7042 or deb. <br />about the survey and legal description.
