5.0 STAFF COMMENTS: <br />S.l When reviewinQ requests for vacating a public ROW, the Public Works/EnQineering <br />Departinent detennines whether the request will, iminediately or in the future, have an <br />adverse impact the general health, welfare or safety of the citizens of the City of <br />Roseville. Further, there needs to be a joint deterinination fi-om the PuUlic Works <br />Department aild the Minnesota Deparnnent of Transportatio�l (MNDOT) of whether the <br />Walnut Street ROW is or will be necessary to facilitate the distribution of traffic between <br />the Lauderdale neighborhood to the south and State Highway 280 to the north, whether <br />public utilities lie underneatli the right-of-way, and how best to protect the public interest <br />52 The Public Works/Engineering Departme�lt and MNDOT has determined that the City <br />has no plans to improve Walnut Street in that location and that the interests of the public <br />will not be comproinised by vacating the portion of the Walnut Street ROW that overlaps <br />the Midland Hills property. The site plan included with this staff report (Attachment C) <br />illustrates the Walnut Street ROW subject to the vACAT�oN request. <br />5.3 A legal description of the land to be vacated has not yet provided, so it is unclear whether <br />the rec�uest is to vacate the entire Walnut Street ROW in tliis location or just that portion <br />of ROW overlapping the applicant's property.
