WHEREAS, that motion passed on a three to one vote, with all Council members <br />supporting the motion stating on the record the reasons for their support of the denial of <br />the request for a conditional use pertnit; and <br />WHEREAS, staff and the City Attorney were directed to prepare findings of fact <br />based upon the record and the reasons for denial as stated by Council members at the <br />time of the vote to deny the conditional use permit application. <br />NOW, THEREFORE, BE IT RESOLVED, that the Roseville City Council hereby <br />adopts the following Findings of Fact for the denial of the conditional use permit <br />requested by Red Dog Holdings, LLC. <br />FINDINGS OF FACT <br />A. The Roseville City Council finds that the proposed use will have an adverse <br />impact on market value of surrounding properties. <br />B. The Roseville City Council finds that the proposed use would have an <br />adverse impact on public facilities in the area. <br />C. The Roseville City Council finds that the proposed use will have a negative <br />impact on the general public health, safety and welfare. <br />Evidence in the record that supports these findings includes the following <br />facts: <br />The record indicates that the location of the proposed use is near an <br />elementary school and a residential area. Other major retail <br />businesses are also close by in the area. <br />2. The record shows that an existing pawn shop located in the City of <br />Roseville has had incidents of criminal behavior associated with it, <br />involving the receipt of stolen items. The number of incidents, <br />representing slightly less than an average of twice a week, is <br />significantly more than other types of businesses. This represents an <br />increase in crime in the area <br />3. Historically, pawn shops have been associated with criminal <br />behavior, which has led to State and City regulation. However, that <br />regulation is not necessarily effective at deterring certain types of <br />crime, which can lead to an increase in crime in surrounding <br />businesses and the surrounding area. <br />2 <br />--. -� <br />
