z� 4.0 <br />zz 4.1 <br />23 <br />BACKGROUND <br />The property at 2181 — 2195 Snelling Avenue has a Comprehensive Plan designation of <br />Business (B) and a zoning classifcation of General Business District (B-3). <br />2�} 4.2 This Cotv�[T[otvAL UsE PE�vt�T (CUP) request has been prompted by the applicant's <br />25 desire to operate a pawn shop within the existing shopping center. In addition to an <br />z6 approved CUP, a separate business license is required from the City for such a use. <br />z� 5.0 STAFF COMMENTS <br />za 5.1 The subject tenant space, 2189 Snelling Avenue, lies between Kinkos/Fedex and China <br />2y Jen within the Rosewood Shopping Center. Section 1005.015 (Business District Uses) of <br />so the City Code allows pawn shops with an approved CUP. <br />3� 5.2 Section 1013 of the Roseville City Code allows the City Council to grant CUP's for land <br />sz uses that are conditionally permitted in a zoning district and, in order to protect the public <br />ss health, safety, and general welfare, any additional conditions deemed necessary may be <br />3a imposed that are above and beyond the licensing requirements and operating regulations <br />35 for Pawnbrokers. <br />36 <br />37 <br />38 <br />39 <br />40 <br />41 <br />az <br />43 <br />44 <br />45 <br />46 <br />47 <br />a� <br />�y <br />5.3 On March 13, 2008 representatives of the Roseville Police Department and Planning <br />Division met to review the proposal by Red Dog Holdings to establish a pawn shop in the <br />vacant tenant space at Rosewood Shopping Center. At the meeting it was indicated that <br />the Police Department has a good relationship with Pawn America and would expect a <br />similar relationship with Cash-n-Pawn. Further, the Police representative stated that §311 <br />(Pawnbrokers and Precious Metal Dealers) of the City Code governs the licensing and <br />operational requirements for such uses. Attachment C following this staff report contains <br />the licensing requirements. <br />5.4 On March 24, the City Planner emailed the applicant seeking additional information <br />regarding the Cash-n-Pawn business. The applicant replied with the following <br />information: The Cash-n-Pawn for Roseville is a new store. The applicant has 18 such <br />business in Minnesota, Missouri, and Indiana. The Roseville Cash-n-Pawn will not be <br />cashing checks or providing "pay day loans," which require separate licensing, nor will <br />they be seeking licensure for selling guns or pornography. <br />so 6.0 REVIEW OF CONDITIONAL USE PERMIT CRITERIA <br />5� 6.1 Section 1013.01 (Conditional Use Permits) of the City Code requires the Planning <br />sz Commission and City Council to consider the following criteria when reviewing a CUP <br />53 application: <br />5� a.
