24 4.0 STAFF COMMENTS <br />25 4.1 City Code § 1104.04B (Recombination) allows the transfer of property from one <br />26 parcel to an abutting parcel upon the approval of the City Council. No public <br />2� hearing is required provided that the proposal does not cause any nonconforming <br />2� condition on the properties involved. <br />2g 4.2 So long as the garden shed near the southeast corner of 1000 Roselawn Avenue is <br />3o removed to a code-compliant location (i.e., 5 feet from the side and rear property <br />3i lines and 6 feet from other structures), the proposed recombination would not <br />32 create any new nonconforming conditions nor exacerbate any existing <br />33 nonconformities. <br />34 4.3 If approved, the proposed recombination would not create any new lots and would <br />35 have no effect on the surrounding properties. <br />36 S.O STAFF RECOMMENDATION <br />3� Based on the comments and findings outlined in Sections 4 and 5 of this report, <br />3� the Planning Division recommends approval of the proposed RECOMB�1vAT�Otv <br />39 MINOR, subject to the following conditions: <br />ao a. Drainage easements consistent with Code requirements must be dedicated on <br />ai both parcels; <br />a2 b. The garden shed on the 1000 Roselawn Avenue property must be relocated to <br />4:� a location at least 5 feet from the rear and new side property lines and 6 feet <br />44 from the other structure on the property; <br />45 c. Within 30 days of the date of City Council approval, a quit claim deed, <br />46 certificate of survey, and new legal descriptions consistent with the proposed <br />4� recombination minor subdivision reviewed with this application in <br />4� Attachment C shall be submitted to the Community Development Director for <br />ay final review, pursuant to § 1104.04B of the City Code; and <br />5o d.
