,' <br />.� <br />Draft Resolution Attachment E <br />EXTRACT OF MINUTES OF MEETING OF THE <br />VARIANCE BOARD OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the <br />City of Roseville, County of Ramsey, Minnesota, was held on the 3`d day of September <br />2008 at 5:30 p.m. <br />The following members were present: <br />Variance Board Member introduced the following resolution and <br />moved its adoption: <br />VB RESOLUTION NO. 81 <br />A RESOLUTION APPROVING A VARIANCE TO §1004 (RESIDENCE <br />DISTRICTS) OF THE ROSEVILLE CITY CODE FOR ANN GEROLD STIBAL, <br />472 BAYVIEW DRIVE (PF08-022) <br />WHEREAS, the Sagerts have requested a VARIANCE to § 1004.016 (Structure <br />Setbacks) of the Roseville City Code; and <br />WHEREAS, this property is addressed as 2730 Saint Albans Street, and is legally <br />described as: <br />SECTION 13 TOWN 29 RANGE 23 SUBJ TO BAYVIEW DR THE E 75 FT OF W <br />451 FT OF S 125 FT OF SE 1/4 OF NW 1/4 OF SEC 13 TN 29 RN 23 <br />PIN: 13-29-23-24-0032 <br />WHEREAS, Section 1004.016 requires a 30-foot setback from the rear property <br />line for principal structures and elevated, attached decks; and <br />WHEREAS, the existing nonconforming principal structure and elevated, <br />attached deck encroach 12 feet into the required setback; and <br />WHEREAS, Ms. Gerold Stibal seek to expand the existing elevated, attached <br />deck such that it would encroach an additional 8 feet into the required 30-foot setback, <br />requiring a 20-foot variance; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present <br />and support can be given to deviate from the strict requirements of the Roseville City <br />Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to <br />APPROVE a 20-foot VARIANCE to Section 1004.016 of the City code, subject to the <br />following conditions: <br />Page 1 of 3 <br />
