4.O BACKGROUND <br />4.1 Ms. Gerold Stibal owns the residential property at 472 Bayview Drive. The property has <br />a Comprehensive Plan designation of Low-Density Residential (LR) and a zoning <br />classification of Single-Family Residence District (R-1). <br />4.2 Like the rest of the residential properties on the western end of McCarrons Lake, this <br />parcel was not created as part of a plat and City records do not contain a minor <br />subdivision approval that would have created the subject property. Although this house <br />was not built until 1972, many of the surrounding parcels were improved in the 1950s, <br />1940s, or earlier; it seems likely, therefore, that this property was created prior to the <br />establishment of minimum lot sizes in 1959 with the adoption of the City Code. <br />5.0 STAFF COMMENT <br />5.1 Residential lots are required to be at least 85 feet in width and 110 feet in depth and have <br />a minimum lot area of 11,000 square feet. This parcel is only 75 feet wide and, after <br />subtracting the Bayview Drive right-of-way, it is only 100 feet deep and 7,500 square <br />feetin area. <br />5.2 Section 1004.016 (Residence Setbacks) of the City Code requires homes to be set back a <br />minimum of 30 feet from front and rear property lines; the existing house meets the <br />requirement for the front yard, but the foundation is only 26 feet from the rear property <br />line. Ground-level decks may extend to as near as 2 feet from side and rear property <br />lines, but decks that are elevated above of the ground, like the existing deck, are subject <br />to the same 30-foot rear yard setback as the principal structure. The existing deck stands <br />about 17 feet from the rear property line. <br />5.3 In a suburban community like Roseville where residential parcels are generally rather <br />deep and sidewalks along the street are rare, household recreational activities tend to be <br />in the back yard where the setting is more private; this is in contrast to a traditional urban <br />setting where front porches tend to be near to the sidewalk, facilitating and encouraging <br />interaction between porch-sitters and their pedestrian neighbors. Roseville's zoning <br />regulations requiring that homes be set back at least 30 feet from the rear property lines <br />are intended to foster and preserve the privacy of one's back yard. The current property is <br />somewhat unusual, however, in that its rear property abuts the side property line of its <br />neighbor to the south. <br />5.4 In 1987, this neighboring property to the south received a variance for a garage/home <br />addition that extended to 3 feet from its northern side property line. While this previous <br />variance has no legal bearing on the present request, it had the effect of bringing the <br />neighboring principal structure within 30 feet of the applicant's home and compounding <br />the cramped feel of an already small space. The combination of this previous variance <br />and the substandard parcel size and rear yard setback of the subject property, along with <br />the relatively steeply sloping grade, has created a back yard that is difficult to enjoy from <br />ground level. <br />5.5 The proposed deck addition is intended to make the rear yard more enjoyable by <br />expanding the area that is level and elevated so as not to feel so crowded by the two <br />principal structures that so tightly frame the space. <br />5.6 Section 1013 of the Code states: "Where there are practical difficulties or unusual <br />hardships in the way of carrying out the strict letter of the provisions of this code, the <br />PF08-035 RVBA 090308 <br />Page 2 of 4 <br />� <br />� <br />� <br />
