See Section 5 of this report for further information and <br />Section 6 of this report for detailed recommendation. <br />3.O SUMMARY OF SUGGESTED ACTION <br />3.1 ADOPT VARIANCE BOARD RESOLUTION 83 approving the requested VARIANCE to <br />§ 1012.02B(2) (Legal Encroachments) of the City Code to allow installation of the <br />proposed fence; see Section 7 below for detailed action. <br />4.0 <br />4.1 <br />BACKGROUND <br />Mrs. Lasser owns the residential property at 3012 Old Highway 8. The property has a <br />Comprehensive Plan designation of Low-Density Residential (LR) and a zoning <br />classification of Single-Family Residence District (R-1). <br />4.2 Talia Place Apartments, a multi-family residential use, abuts the applicant's side property <br />line, and Mrs. Lasser's desire for increased privacy and security prompt the current <br />variance request. <br />S.O STAFF COMMENT <br />5.1 Parking areas for new or renovated multi-family residential developments would be <br />required by the Code to have 6.5-foot-tall privacy fences to screen adjacent single-family <br />residential properties. The Code does not, however, provide any regulatory tools to <br />compel the Talia Place Apartments property to install such a fence if they're not seeking <br />other approvals.
