-� -� <br />6.4 Details of the gazebo itself can be found in Attachment D. <br />6.5 An open house meeting as required for IUP applications was held on September 8, 2008; <br />a summary of the comments raised at the meeting is included with this staff report as <br />Attachment E. Since the open house, Planning Division staff has received one additional <br />comment expressing opposition to the gazebo because of concern about cigarette smoke <br />emanating from the gazebo and entering the nearby residential units. A visit to the site <br />revealed a 6-foot screening fence between the parking lot and the property line shared <br />with the Rosewood Village condominium in addition to a couple of mature deciduous <br />trees immediately adjacent to proposed Location B of the gazebo. <br />6.6 Planning Division staff also received comments about noise coming from the trash <br />containers in about that same location. Staff recommends requiring the construction of a <br />fence enclosure around the trash containers and ensuring that the containers' lids dodt <br />open and slam closed in the wind. <br />6.7 Some IUP requests represent uses with potentially significant impacts to be mitigated <br />through conditions of approval and/or very limited timelines, but this request does not <br />present those same issues or concems so staff is recommending allowing an approved <br />IUP to be valid for 5 years. <br />7.O STAFF RECOMMENDATION <br />7.1 Based on the comments and findings outlined in Sections 5 and 6 of this report, the <br />Planning Division recommends approval of the request for a INreaiM UsE PeaMir to <br />allow the construction of a gazebo at 1700 Highway 36, pursuant to § 1012.09 (Interim <br />Uses) of the Roseville City Code subject to the following conditioos: <br />a. <br />b. <br />c. <br />d. <br />The size and appearance of the gazebo shall be consistent with the plans included <br />as Attachment D of this staff report; <br />The gazebo shall be situated similar to Location B in the site plan included as <br />Attachment C of this report; <br />A fence that is similar in sryle to the existing fence shall be constructed to enclose <br />the trash containers within the parking area; <br />The applicant shall work with staff to find a way to prevent the trash container <br />lids from opening in the wind; and <br />e.
