-.. � <br />6.5 An open house meeting as required for IUP applications was held on September 8, 2008; <br />a summary of the comments raised at the meeting is included with this staff report as <br />Attachment E. Since the open house, Planning Division staff has received one additional <br />comment expressing opposition to the gazebo because of concern about cigarette smoke <br />emanating from the gazebo and entering the nearby residential units. A visit to the site <br />revealed a 6-foot screening fence between the parking lot and the property line shared <br />with the Rosewood Village condominium in addition to a couple of mature deciduous <br />trees immediately adjacent to proposed Location B of the gazebo. <br />6.6 Planning Division staff also received comments about noise coming from the trash <br />containers in about that same location. Staff recommended requiring the construction of a <br />fence enclosure around the trash containers; the applicant has applied for a permit for this <br />enclosure and because the permit has already been issued the related requirement has <br />been removed from the recommended conditions of approval. Staff continues to support <br />the recommendation of the Planning Commission to ensure that the trash containers' lids <br />don't open and slam closed in the wind. <br />6.7 Some IUP requests represent uses with potentially significant impacts to be mitigated <br />through conditions of approval and/or very limited timelines, but this request does not <br />present those same issues or concerns so staff is recommending allowing an approved <br />IUP to be valid for 5 years. <br />7.O PUBLIC HEARING <br />7.1 Nobody from the public was in attendance at the public hearing, although Planning <br />Division staff received a couple of emails primarily expressing the concern that cigarette <br />smoke would drift from gazebo inproposed Location A or B into the windows of the <br />condominium units. <br />7.2 After considering the staff recommendation and the public input, the Planning <br />Commission voted 6-0 to recommend approval of the requested IUP; minutes from the <br />public hearing are included with this report at Attachment F. <br />S.O RECOMMENDATION <br />Based on the recommendation of the Planning Commission and the comments and <br />findings outlined in Sections 5 and 6 of this report, the Planning Division recommends <br />approval of the request for a INTEttttv� UsE PERtvt�T to allow the construction of a gazebo <br />at 1700 Highway 36, pursuant to § 1012.09 (Interim Uses) of the Roseville City Code <br />subject to the following conditions: <br />a. The size and appearance of the gazebo shall be consistent with the plans included <br />as Attachment D of this staff report; <br />b. The gazebo shall be situated similar to Location B in the site plan included as <br />Attachment C of this report; <br />c. The applicant shall work with staff to find a way to prevent the trash container <br />lids from opening in the wind; and <br />d.
