� <br />2769 Cohansey Circle <br />Roseville, MN 55113 <br />Apri127, 2009 <br />City of Roseville <br />City Council <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br />Dear City Council Members, <br />As property owners in the Owasso Ridge Homeowners' Association; my wife and <br />I strongly urge you to approve the PUD amendment proposed by our association <br />members. <br />The existing encroachments and building setback restrictions have caused us a <br />financial hardship. <br />Our house was built without a rear deck because the builder informed us there <br />was a 30 foot common lot building and utility easement restriction to the rear of the <br />property. We later learned the utility easement was approximately 15 feet. The builder <br />subsequently built the property to the south of us with a deck structure encroachment that <br />extends approximately 14 feet into the common lot. <br />We attempted to sell our property for 13 months from May 2007 to June of 2008. <br />All prospective buyers inquired about the feasibility of adding a deck. When informed <br />that no deck could be built, prospective buyers would question why the neighbor's deck <br />was allowed as it can be seen from our kitchen window extending 14 feet into the <br />common lot. <br />In June 2008, we received our first and only Purchase Agreement; contingent <br />upon the approval to build a deck. When our HOA was not able to approve the addition <br />of a deck, the sale of the house fell through. We have cancelled our Listing Agreement <br />because of the deck issue, however we must sell the properiy within the next 12 months. <br />Our house was last listed at $519,000. Prospective buyers of a house in this price <br />range expect a rear deck or screen porch. If we are able to add a rear deck; we believe we <br />can manage the sightlines for our neighbors by adding trees and landscaping to make the <br />common lot even more appealing. In fact, an area developed in North Oaks has less than <br />30 foot setback requirements and they have managed their sightlines with trees and <br />landscaping.
