Even with staff support, the City Council rejected the applicant's request for the <br />interim use. <br />The PIK Terminal was operating as a legally nonconforming use, which allowed it certain rights to <br />continue in perpetuity under the city code. However, with the discontinuation of the use since at least <br />2006, planning staff believes that the property owner has lost any rights to restart the former use on the <br />site. Section 1012.04 of the City code determines a nonconforming use is discontinued after being <br />non-operational for a period of more than one year. Attached to this letter are aerial photos from 2006 <br />and 2008 that show the site without trucks trailers storage, which indicates that it has not been in use <br />as a truck terminaUstorage area for at least three years. <br />The future land use designation of Community Mixed Use allows for a wide variety of development <br />options for the site and we are setting forward on the development of the new zoning district that will <br />provide specific use guidance and development guidelines for this site.
