,--� <br />^ ��z , <br />March 26, 2010 <br />Riaz Hussain <br />1901 Lexington Avenue <br />Roseville, MN 55113 <br />RE: Denial of Conditional Use Permit Amendment <br />Dear Mr. Hussain, <br />.�.� <br />As you know from your attendance of the March 22, 2010 City Council meeting, the City <br />Council denied your application to amend the existing Conditional Use Permit (CUP) at 1901 <br />Lexington Avenue, based on the following findings related to the standard criteria that must be <br />considered when taking action on a proposed conditional use: <br />a. Public Works staff has determined that utilization of the parking areas adjacent to <br />Autumn Street unnecessarily increases the potential for traffic conflicts because of the <br />close proximity with the high traffic volume of Lexington Avenue; <br />b. If the parking areas remained, the size and location of the parking areas makes it <br />necessary for motorists to back in from the street or back out onto the street because there <br />is no space for vehicles to enter in a forward direction, turn around within the property <br />boundaries, and exit in a forward direction, and it is predominantly this need to back into <br />or out of the parking areas that has the greatest potential to create traffic hazards in the <br />area; and <br />c. The potential traffic conflicts related to the continued use of the existing parking areas <br />needlessly compromise the public safety. <br />This denial doesn't require you to change anything about the conditions or uses on the property; <br />instead it merely means that the original provisions of the CUP will continue to apply to the <br />property at such times as it might be used as a veterinary clinic.
