4.O BACKGROUND <br />4.1 The property at 2680 Arthur Street has a Comprehensive Plan designation of Business <br />Park (BP) and a zoning classification of Retail Office Service District (B-4). <br />4.2 This �vTEx�M UsE request has been prompted by the applicant's desire to establish a <br />temporary and limited library facility in a location where the zoning does not permit <br />libraries. <br />4.3 Such applications were formerly referred to as Interim Use Permits, but the word <br />"permit" is being eliminated in an effort to sharpen the distinction between land use <br />approvals and building permits. Although this represents a change in terminology, the <br />nature of interim use approvals will remain the same because they never actually <br />involved permits per se. <br />S.O INTERIM USE APPLICATIONS <br />Section 1012.09 (Interim Uses) of the City Code establishes the regulations pertaining to <br />INTERIM USES. <br />5.1 Section 1012.09A states: The City Council may authorize an interim use of property. <br />Interim uses may not be consistent with the land uses designated on the adopted Land <br />Use Plan. They may also fail to meet all of the zoning standards established for the <br />district within which it is located. <br />5.2 Section 1012.09B states: The City Council may attach conditions to Interim Use Permits <br />�sicJ. In reviewing [suchJ applications, the City will establish a specific date or event <br />that will terminate the use on the property. The Council will also determine that the <br />approval of the interim use would not result in adverse effects on the public health, <br />safety, and general welfare, and that it will not impose additional costs on the public if it <br />is necessary,for the public to take the property in the fi�ture. <br />6.O STAFF COMMENTS <br />6.1 Section1005.015 (Business District Uses) of the zoning regulations prohibits public uses <br />(e.g., libraries) in B-4 districts, which are intended to facilitate relatively high intensity, <br />regional commerce. The primary goal of the proposed �tvTExiM usE is to continue <br />providing limited library services while the existing Ramsey County Library facility is <br />being expanded as proposed in the Library's PUD application; Ramsey County is still in <br />the process of applying for Final PUD approval. <br />6.2 A building permit is required for various improvements to make the office/warehouse <br />space suitable for the Library's needs, and although special approvals are being sought to <br />allow this temporary use, any building modifications must meet the requirements of the <br />building code. <br />6.3 The only potential points of concern identified by Community Development staff were <br />the adequacy of parking and the location of a trash container. <br />a. It appears that modifications to the interior space will preclude storage of a trash <br />container within the building as required by the zoning ordinance. While not consistent <br />with zoning requirements, Planning Division staff believes that a trash container may be <br />located in the rear of the building (i.e., the east side) for the duration of the temporary use <br />without having a significant impact on the adjoining properties. <br />PF09-004 RPCA 020409 <br />Page 2 of 4 <br />� •-\ <br />
