i • <br />venturers, or associates between the parties hereto ar as constituting the <br />BORROWER as the employee of the AUTHORITY for any purpose or in <br />any manner whatsoever. The BORROWER is an independent contractor <br />and neither it, its employees, agents nor representatives are employees of <br />the AUTHORITY. <br />7.12. Upon the expenditure of all iunds covered by this GRANT <br />AGREEMENT, GRANTEE shall submit a report to AUTHORITY on the <br />progress of the work and a financial summary of all sources and uses of <br />funds for the work. Prior to the date upon which the GRANTEE's <br />transferee obtains a Certificate of Occupancy for all buildings constructed <br />upon the PROPERTY ("COMPLETION"), GRANTEE shall provide <br />quarterly progress reports detailing all activities undertaken to ameliorate <br />contamination, prepare the PROPERTY for redevelopment, market the <br />PROPERTY, and redevelop the PROPERTY. Upon COMPLETION, <br />GRANTEE shall provide a final report addressing the outcomes, including <br />but not limited to, the following criteria intended to maximize public <br />investment: <br />a) building coverage ratio; <br />b) a detailed list of all new jobs created including position description <br />and annual wage and benefit package. Retained and/or relocated jobs <br />should be listed separately and include the same information; <br />c) a detailed accounting of all expenses associated with acquisition. <br />clean-up, redevelopment and marketing of the site; <br />d) a detailed description of GRANTEE's efforts made to ensure that <br />buildings constructed at this site are energy efficient and high- <br />performance. <br />Page -10- <br />
