• � <br />AGREEMENT BETWEEN <br />RAMSEY COUNTY HRA and CITY OF ROSEVILLE <br />FOR ENVIRONMENTAL RESPONSE FUNDS <br />This is an Environmental Response Fund Grant Agreement made this day of <br />, 2009, between the Ramsey County Housing and Redevelopment Authority <br />(`AUTHORITY") and City of Roseville, a Minnesota non-protit corporation ("GRANTEE") <br />(sometimes referred to as the "PARTIES" or a"PARTY"). <br />WHEREAS, on December 22, 2002, the AUTHORITY approved an increase in the <br />mortgage registration and deed tax effective February l, 2003 through December 31, 2007, and <br />which was reinstated effective July 1, 2008 through December 31, 2012, for the purpose of <br />creating an Environmental Response Fund per Minnesota Statutes, section 383A.80; and <br />WHEREAS, on August 11, 2009, based upon an application from GRANTEE dated May <br />1, 2009 ("APPLICATION"), the AUTHORITY approved an Environmental Response Fund loan <br />to GRANTEE in the amount of Thirty Thousand Dollars ($30,000.00) for remediation activities <br />at the Twin Lakes site in the City of Roseville; and <br />NOW, THEREFORE, in consideration of the above premises and the mutual covenants <br />and agreements set forth herein, the PARTIES agree as follows: <br />DEFINITIONS For purposes of this agreement, the following terms shall have <br />the following meanings: <br />1.1. "GRANT AGREEMENT" means this Grant Agreement. <br />1.2. "AUTHORITY" means Ramsey County Housing and Redevelopment <br />Authority. <br />1.3. "GRANTEE" means City of Roseville, a municipal corporation. <br />1.4. "IMPROVEMENTS" means the remediation activities specifically set <br />forth in the APPLICATION. <br />1.5. "GRANT" means the amount of Thirty Thousand and 00/100 Dollars <br />($30,000.00) to be granted to GRANTEE to finance the project. <br />1.6. "PROJECT" means the PROPERTY and the IMPROVEMENTS. <br />1.7. "PROPERTY" means the real property located in the County of Ramsey, <br />State of Minnesota that is legally described on the attached Exhibit "A". <br />In addition, other terms will be defined in various sections of this GRANT <br />Page -1- <br />
