The proposed encroachment into the <br />side setback (ending 3 feet from your shared property boundary) was approved with the <br />condition that a gutter/downspout be installed along that eave to capture rain water and <br />directing in into the front yard instead of allowing it to drain off the roof toward your <br />yard. <br />You might recall that I had mentioned a particular (and peculiar) zoning ordinance that <br />allowed a one-level garage to extend into the front yard without special approvals; I didn't <br />remember exactly how the provision is worded, but having looked it up, it says that an <br />attached garage "may extend up to three feet into a required front yard as long as there is <br />no living space above it." Here's how we applied the ordinance to this property: the existing <br />setback of the southernmost portion of the home is about 33-1/2 feet so, according to the <br />Code requirements, the garage would be permitted extend to about 30-1/2 feet from the f ront <br />property line. In this case, Mr. Bell was amenable to building the section of the proposed <br />garage addition with the 10-foot overhead door only as far west as the extent of the existing <br />home, and then extending the portion of the garage with the 7-foot overhead door an <br />additional 2 feet, ending about 31-1/2 feet from the f ront property line. <br />
